Tata Capital is hiring for the role of Legal & Remedial Manager!

Responsibilities of the Candidate:

• Handle all legal matters/practices to secure the best interests of the organization in debt recovery through SERFASEI and other legal action.
• Assist in Executing the strategies and procedures to be followed in debt recovery and maintain and prepare legal MIS for the assigned area.
• Provide legal opinion on debt recovery, arbitration, negotiable instruments act, civil matters and criminal matters, and execution of warrants.
• Ensure amicable resolution against cases filed in police stations and ensuring execution of summons / bailable or nonbailable warrants/awards/orders received from the courts with police help.
• Manage the recovery litigation, physical possession, and auction under arbitration and SARFAESI laws and provide a proactive legal strategy for all key accounts.
• Track all legal cases to ensure no slippages, visiting NPA accounts along with the collection team for faster recovery
• Initiate appropriate legal actions in delinquent accounts against borrowers under the Arbitration and Conciliation Act 1996, Negotiable Instrument Act, for recovery of dues including filing criminal complaints in qualified cases and taking them to logical conclusion.
• Assist the legal collections team with the implementation of a recovery agenda through deployment strategies.
• Keep abreast of all the latest developments/trends in local law/best practices with respect to collections, security creation, and loan documentation.
• Ensure compliance with all Audit / RBI regulations as well as policies and procedures of the company.

Requirements:

• Proven soft skills in Excel, MS Word, and online legal search.
• Basic understanding of the Collection process and NPA provisioning
• Qualification: Law Graduate/ Post Graduate
• Educational Qualification: LLB & Above LLM
